The Planning Proposal and associated draft Development Control Plan (DCP) for 52 Alfred Street South, Milsons Point (PP5/20) is on public exhibition from Wednesday, 10 May 2023 until Wednesday, 21 June 2023.

The Planning Proposal and associated draft DCP may be viewed in the Document Library (on this page); at Council’s Customer Service Centre200 Miller Street, North Sydney; and Stanton Library, 234 Miller Street, North Sydney, during opening hours.

About the Planning Proposal

The Planning Proposal seeks to amend NSLEP 2013 to increase the maximum building height control applying to the site from 40m to part RL88 (approximately 69.99m) and part RL84 (approximately 54.42m).

The intent of the proposal is to facilitate a part 17 storey (to Alfred Street South) and part 22 storey (to Glen Street) mixed-use building comprising 125 residential apartments, 3,255m2 of commercial floorspace and 191 basement car parking.

Council resolved to refuse the Planning Proposal at its meeting on 22 February 2021 consistent with the Council Officer’s recommendation and that of the North Sydney Local Planning Panel (NSLPP).

The applicant subsequently lodged a rezoning review with the State Government which determined to allow the Planning Proposal to proceed to Gateway Determination contrary to Council’s endorsed position. The Sydney North Planning Panel (SNPP) in its decision to support the progression of the Planning Proposal, recommended the preparation of a site-specific DCP to manage the future distribution of height and massing across the site and ensure that local impacts and amenity issues are satisfactorily addressed at a future Development Application (DA) stage.

On 28 March 2022, Council resolved to endorse a draft site-specific amendment to North Sydney DCP 2013 and submit it to the Department of Planning and Environment (DPE) for its consideration in issuing a Gateway Determination.

On 11 November 2022, the Minister of Planning issued a Gateway Determination allowing the Planning Proposal to be placed on public exhibition subject to meeting a number of conditions, which included that the Planning Proposal be updated to remove any inconsistencies with Council’s draft DCP from the concept scheme prior to community consultation.
