Planning Proposal 2/17: North Sydney Centre & Draft DCP 2013 Amendment: North Sydney CBD Character Statement

Consultation has concluded

At its meeting on 19 February 2018 Council resolved to forward the Planning Proposal to the Department of Planning, Industry and Environment with a request that the plan be made. This Planning Proposal sought to make the following amendments to NSLEP 2013 in relation to the North Sydney Centre:

  • Remove ‘serviced apartments’ from the list of permissible uses in the B3 Commercial Core zone to the Land Use Table;
  • Amend the Height of Buildings Map to increase the maximum building height limit on a number of sites zoned B3 Commercial Core, consistent with the outcomes of the North Sydney CBD Capacity and Land Use Strategy;
  • Amend the extent to which “special areas” applies to land identified on the North Sydney Centre Map consistent with the outcomes of the North Sydney CBD Capacity and Land Use Strategy.
  • Amend clause 6.1 such that the objectives of Division 1 to Part 6 better relate to the provisions contained within that Division.
  • Amend clause 6.3 to:
    • Ensure the objectives and provisions of the clause align with the outcomes of the North Sydney CBD Capacity and Land Use Strategy; and
    • Restrict the development of sites less than 1000sqm in area to 45m in height.
  • Delete of clause 6.5 in its entirety to remove the requirements for railway infrastructure provision and the gross floor space cap for non-residential development.

North Sydney Local Environmental Plan 2013 (Amendment 23) came into force on 26 October 2018 following its publication on the NSW legislation website. This amendment gives effect to the Planning Proposal and can be accessed at: https://www.legislation.nsw.gov.au/view/pdf/asmade/epi-2018-606.

The associated amendment to NSDCP 2013 came into effect on 15 March 2018 following its publication on Council’s website. The amendment is available to view at North Sydney Council’s Customer Service Centre as well as on Council’s website at www.northsydney.nsw.gov.au

BACKGROUND

On 1 May 2017, Council resolved to forward a Planning Proposal to the Department of Planning and Environment to amend the planning controls relating to North Sydney Centre under North Sydney Local Environmental Plan 2013 (NSLEP 2013). In particular, the proposed amendments include:

  • Removing ‘serviced apartments’ from the list of permissible uses in the B3 Commercial Core zone to the Land Use Table;
  • Amending the Height of Building Map to increase the maximum building height limit on a number of sites zoned B3 Commercial Core, consistent with the outcomes of the North Sydney CBD Capacity and Land Use Strategy;
  • Amending the extent to which “special areas” applies to land identified on the North Sydney Centre Map consistent with the outcomes of the North Sydney CBD Capacity and Land Use Strategy;

On 20 July 2017, the Minister for Planning issued a Gateway Determination, permitting the Planning Proposal to be placed on public exhibition.

In addition, on 26 June 2017, Council resolved to adopt draft amendments to the North Sydney Development Control Plan 2013 (NSDCP 2013) to support the Planning Proposal. The proposed amendments revise the North Sydney CBD Character Statement located in Part C to NSDCP 2013.

The Planning Proposal and draft DCP amendment were exhibited from Thursday 14 September to Wednesday 11 October 2017.

Submissions closed 11 October 2017.
