Notification under Section 154 of the Roads Act 1993 - Renewal of Lease for Public Pathway

Location: Adjoins the rear of 2 Henry Lawson Avenue, McMahons Point

Advertising Period: 27 March to 23 April 2023

Section 153 of the Roads Act 1993 provides that the Roads Authority (Council) may lease land comprising a public road to the owner or lessee of land adjoining the public road, if in its opinion, the road is not being used by the public.

Milk & Two Pty Ltd are currently occupying a portion of Council’s public road which adjoins Lot 1 in DP 572828 (also known 2 Henry Lawson Avenue, McMahons Point), at the rear of the property. This portion of the unused road borders the beautiful foreshore of Lavender Bay and is less that a minutes’ walk from McMahons Point Wharf, thereby providing easy access to visitors and tourists wanting to explore and dine in North Sydney.

The existing lease expires on 29 July 2023 and the tenant has requested that their lease be renewed for a further five (5) years.

New Lease: 30 July 2023 to 29 July 2028

Purpose: The tenant leases this space from Council to provide an extension to the existing restaurant - refer to Location Map available from the document library.
