On 23 March 2019 Council received a Planning Proposal to amend NSLEP 2013 as follows:

  • Establish a maximum height of buildings from 12m to RL 133 for the site (an increase of 62m-72m);
  • Establish a maximum FSR of 6.1:1 for the site;
  • Introduce a new Special Provisions Map within the NSLEP 2013 and identify the Precinct on the map as ‘Area 1’; and
  • Amend Section 6 Additional Local Provisions to include a section ‘6.20 East Walker Street Precinct’ to establish controls associated with lot amalgamation, overshadowing and community infrastructure, including a maximum height of buildings of RL148 (an increase of 77-87m)

Council considered this proposal at its meeting of 26 August 2019, wherein it resolved not to support the progression of this Planning Proposal.

In response to Council’s refusal, the applicant sought a Rezoning Review through the Department of Planning, Industry and Environment. The Rezoning Review was heard by the Sydney North Planning Panel who resolved that the Planning Proposal has merit and should proceed to the next stage of the plan making process, being the issuing of a Gateway Determination. A Gateway Determination was issued on 6 July 2020, enabling the Planning Proposal to proceed to public exhibition.

Due to Council not supporting the progression of the Planning Proposal, it declined the offer to administer the remaining plan making functions, including the public exhibition of the Planning Proposal.

The Sydney North Planning Panel has advised Council that the Planning Proposal is to be placed on public exhibition from Thursday 29 October 2020 until Thursday 26 November 2020.
