PUBLIC NOTICE OF INTENTION OF PROPOSED LEASE IN ACCORDANCE WITH SECTION 47A OF THE LOCAL GOVERNMENT 1993

The Site

The Coal Loader Sustainability Centre within situated on Folio Identifier 99 in DP1048930. This land is categorised as Crown Land, and Council operates as its Crown Land Manager in accordance with the provisions outlined in Section 3.23 of the Crown Land Management Act 2016, as though it were Community Land under Section 46 and 47 of the Local Government Act 1993.

The Coal Loader Sustainability Centre, established in approximately 2011, serves as a valuable community resource for educating local and regional residents about sustainable living practices. Among its facilities is a café building, structured with a 79.3m² area for seating and a kitchen, complemented by an alfresco-style dining space measuring 18.5m². The property also encompasses a storage section of 7.8m², and the Council has contemplated the leasing of an extra outdoor space in Jacaranda Square for dining, measuring 17.1m². In total, this constitutes a leased area of 122.7m² (refer to the Map and Survey Plan).

Details

After an extensive Expression of Interest process conducted from 17 July to 14 August 2023, Council has successfully identified a suitable tenant to lease the Coal Loader Café.

Legal Framework

Situated on Crown Land, the Coal Loader site falls under the Council management as its Crown Lands Manager, treating the site as Community Land as outlined in Sections 46 and 47 of the Local Government Act 1993. Consequently, Council, in compliance with Section 47A of the Act, is obligated to give public notice of the proposed lease for a 28-day period, during which time, submissions from the public will be received.

STATUTORY ADVERTISEMENT

In pursuance of Section 47A of the Local Government Act 1993, it is notified that North Sydney Council intends, at the expiration of 28 days after the date of publication of this notice, to grant an exclusive lease to the tenant, specified in Schedule 1, in respect of the land specified in Schedule 2, and for the term and purpose specified in Schedule 3.
